Separation Agreements

More and more separations are resolved outside of the court room. This is most often achieved through a separation agreement. The separation agreement is negotiated by a lawyer acting on your behalf. All issues arising from the separation are resolved through discussion and the exchange of positions between your lawyer and the lawyer representing your spouse. This is the most cost-effective way to resolve the issues arising from your separation. The other clear benefits are that the parties retain control of the outcome and the details of the separation remain confidential. Most people would prefer to resolve things without going to court. You should be aware that each spouse is required to use different lawyers from different law firms. The requirement that each spouse have their own lawyer ensures that both spouses have a legal advocate that is solely focused on their client’s best interests. It is also essential that you be able to privately discuss all issues with your lawyer and for him to provide you with honest and independent advice. The right to independent legal advice is of such a high importance in our law that any agreement reached without the parties having independent legal advice runs the risk of being declared invalid by the court.
